Protecting the Rights of Personal Data Subjects

Pursuant to paragraph 1, Article 23, of the Federal Law No. 152-FZ of July 27, 2006,On Personal Data, and paragraph 1 of the Statute On the Federal Service for Supervision of Communications, Information Technology, and Mass Media, approved by the Regulation No. 228 of March 16, 2009, of the Government of the Russian Federation, the federal executive authority performing control and supervision in communications and mass media (Roskomnadzor) is the Competent Authority for protecting the rights of personal data subjects, and it is responsible for supervision and statutory compliance control of personal data processing. 

Article 22 of the Federal Law On Personal Data compelled operators to notify the Competent Authority for protecting the rights of personal data subjects about their intention to process personal data prior to personal data processing. 

Pursuant to section 4 of Article 25 of the aforementioned Federal Law, operators processing data from and including the effective date of this Federal Law shall submit a notice, specified in section 3 of Article 22 of this Federal Law, to the Competent Authority for protecting the rights of personal data subjects on or prior to January 1, 2008 (except as otherwise provided by section 2 of Article 22 of this Federal Law). In accordance with paragraph 3 of Article 22 of the Federal Law On Personal Data, Roskomnadzor developed a form of the Notice of Processing (Intention to Process) Personal Data, based on the list of mandatory fields. Roskomnadzor also drew up Recommendations on Filling in a Notice of Processing (Intention to Process) Personal Data. 

Filled in notices should be signed in writing by an authorized person, or signed by a digital signature pursuant to the Russian legislation, and sent via mail or E-mail respectively to a regional office of Roskomnadzor according to the jurisdictional territory, where the operator processes (will process) personal data.
