Roskomnadzor issues its first comment to the Law On Personal Data

A comment to Federal Law No. 152-FZ On Personal Data came out on June 16, 2015.

In 2014 Roskomnadzor called attention to issues of enlightenment in the sphere of protecting rights of the personal data subjects. Thus, development of a comment to the Law On Personal Data has become one of the points of the Roskomnadzor’s strategy of protecting personal information of citizens since April 2014.

The comment was issued under the editorship of Antonina Priezzheva, Deputy Head of Roskomnadzor. The comment uniqueness is connected with the fact that it has been developed by Roskomnadzor central staff having extensive knowledge and practical experience in the field of personal data. Since the comment is of scientific and practical character, it presents clarifications of doctrinal character in line with special legal interpretation of legislative rules being of applied meaning.

The comment analyzes theoretical issues of personal data processing, examines benefits and drawbacks of the commented Law and gives examples of its application, it also analyzes international legislation, bylaws that were adopted in order to comply with the Law, and acts of allied legislation.

The comment has been also given an appreciation from Law faculty of the Higher School of Economics as well as from Law Department of the St.-Petersburg State University.

Besides, notwithstanding the fact that the comment is primarily destined to help personal data operators to apply the Federal Law on Personal Data, it can be also useful for unlimited scope of persons and can be used in scientific and teaching profession.
