ROSKOMNADZOR: Federal Law on “Protection of Personal Data” will not restrict the Russian citizens` rights

The International Conference on Protection of Personal Data of Russian citizens, initiated by ROSCOMNADZOR, opens today, November 5, 2014, in Moscow.

In the course of the Conference Mr. Alexander Zharov, Head of ROSCOMNADZOR, focused on clarification of the provisions of Federal Law 242 “Protection of Personal Data”, which attracted considerable public attention.

The Head of ROSCOMNADZOR stressed that the transfer of personal data into the territories which do not ensure adequate protection of personal data and do not fulfil the requirements of the Russian jurisdiction shall not be carried out without the consent of the personal data subject.

The cross-border transfer of personal data in itself is not prohibited by this Law.

Thus, this Federal Law will not preclude the Russian citizens from using Internet services, such as hotel booking service or foreign education.

The Head of ROSCOMNADZOR reminded that similar requirements already existed in a number of countries, for example, China, Singapore and India.

Also, the so-called right to be forgotten was raised. Mr. A. Zharov stressed that in Russia a right of this kind has been foreseen since 2006 as the citizens`right to demand the operator of personal data to terminate the processing of personal data, including through Internet.

Among the honored guests of the Conference were: Deputy Chairman of the State Duma of the Federal Assembly of the Russian Federation, Mr. Sergey Zheleznyak, Deputy Head of the Ministry of Communications and Mass Media of the Russian Federation, Mr. Alexey Sokolov, Deputy Chairperson of the Council of the Federation Committee on Constitutional Legislation, Legal and Judicial Affairs and Civil Society Development, Mrs. Lyudmila Bokova.

 

This is the 5th International Conference “Protection of Personal Data” being held in Moscow. The event aims at the discussion of innovations in legislation, exchange of best experiences in the area of personal data protection, improvement of the mechanisms ensuring security and confidentiality of personal data, as well as increase in the quality of the relationship between the authorized bodies.
